Can I Trademark a Title?
You can trademark a title to a book or publication in certain circumstances, namely if you’ve created a series around that work. A single title for a book is not protected under trademark law, however, once you draft and market a series of creative works, you’ll be able to trademark the title of the series. This is because a series is similar to a franchise in that there is one main overarching entity and a number of smaller works under its umbrella, like Star Wars or Star Trek.
If you are an author, poet, musician, filmmaker, cartoonist, or other creative, contact us today to speak with trademark attorney Eric Norton to discuss the possibility of trademarking your work’s title.
